Just when you thought you were getting the hang of the GDPR (General Data Protection Regulation), you learn that things are even more complicated.
That’s been the reaction of many law enforcement bodies that have recently learned about their compliance requirements under the DPA (Data Protection Act) 2018.
The DPA 2018 includes a framework designed specifically for the processing of personal data for law enforcement purposes. This includes processing performed by:
- The police, criminal courts, prisons, non-policing law enforcement; and
- Any other body that has statutory functions to exercise public authority or public powers for law enforcement purposes.
The requirements are outlined in Part 3 of the DPA 2018, and are intended to protect the rights of victims, witnesses and suspects while ensuring law enforcement authorities can continue to tackle crime and other threats effectively.
As such, the requirements apply only to processing that’s necessary for the “prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security”.
Data processed by law enforcement bodies for other purposes will be subject to the requirements of the GDPR and the main body of the DPA 2018
